Is five months too long to wait for final hearing judgement to be issued for divorce after court date?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Divorce lawyer at Richard B. Jacobson Associates, LLC
There are a few strange things in your question, if your divorce is in a Wisconsin Court. We don't have magistrates as such, general or otherwise. In some counties judicial officers called Court Commissioners have powers granted them by the regular Circuit Court Judges, but generally the power to grant a divorce, IF THERE ARE CONTESTED MATTERS, lies only with the Judge, not a Commissioner. I suspect either you are not communicating well with your lawyer (or him with you), or else your lawyer is falling down on the job and you should find a different lawyer to represent you. The first step is to sit down with your lawyer, tell him or her your concerns, ASK TO SEE COPIES OF EVERY LETTER OR EMAIL HE HAS SENT TO THE COURT, and then see if he can straighten things out. If not, he or the Court is falling down on the job. Good luck.

What is the quickest, cheapest, and easiest way to get a divorce?

default-avatar
Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Divorce lawyer at R. Jason de Groot, P.A.
The best way to get this done is on an uncontested basis. Most attorneys in my area charge around 1500 for that, plus there are court costs of just over 420. You might be able to luck out and find local attorney, like me, who does these for 750. I do not advise people to do any legal matter on their own. Basically, there would be a petition, an answer and waiver, an agreement, and a final judgment. But there are more things that need to be drafted.

Tax exemption in divorce settlement can be changed?

Blair Henry Chan
Answered by attorney Blair Henry Chan (Unclaimed Profile)
Divorce lawyer at Blair H. Chan, III, PLLC
Yes, you can ask the court to change the provision of a child support order regarding claiming federal dependency expemptions for a child.  You must prove a substantial change in circumstances has occurred since the prior order that supports changing the allocation of the exemptions, though.
