I would suggest you speak with an attorney, in Michigan and I assume most other states, once a divorce or order of legal separation has been filed the ability to continue to cover the ex spouse or separated spouse on an employment-based medical insurance program terminates. You should also discuss with an attorney about your anticipated payout from his pension, which normally in a divorce would only cover those years you are actually married.

No. If your husband wants you to leave, he would have to formally evict you as if you were a tenant. That does not mean he may not try to force you out, by changing the locks while you are gone. You need to commence an action for either divorce or separation in order to obtain an order from the court protecting you in the event he should try to do so.

It really depends on the grounds she is trying to put forth, her income, your income. Delaware, if qualified,a spouse can get up to half the number of years married unless married over 17 years, so if she qualified she could get spousal support or alimony for 3 1/2 years.
