I want to file for divorce haven't been with husband since 1996 he was deported to Haiti in 2001 what can I do?

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
There is a process you can go through if you do not know where the person lives.  you can use the forms found on the New Jersey Judiciary website.  If you file without an attorney it is called "pro se".  there is a whole packet of forms all grouped together that you can use. One part of it requires you to prove that you provided a copy of the pleadings to the defendant.  If you can't locate him you will have to indicate that you sent it to his last know address, that he lives out of the country, etc.  It will take you a bit longer but you can do it.

I want to divorce my illegal immigrant husband and move to another state with our daughters. Can he stop me?

Answered by attorney Daniel A Levy (Unclaimed Profile)
Divorce lawyer at Raff & Raff, LLP
Just because he is an illegal immigrant does not mean that he has no parental rights. Generally, you cannot move the child to another state without consent from both parents, but a court may allow you to do it anyway if you make an application and can show that it is in the best interests of the child to move elsewhere.

Divorce

Answered by attorney Bari Zell Weinberger
Divorce lawyer at Weinberger Divorce Family Law Group, LLC
Thank you for your question. The house is a marital asset and the equity in it has to be shared. There are several ways to do this. You would benefit from a free consult with an attorney to discuss the best way to handle the division of the equity in the house.
