If the retirement benefits were acquired during your marriage and they were omitted from the judgment, yes. You can re-open the case to get those assets divided. You will probably need to go back to your lawyer or get a new one for this.

I don't understand your question. A MSA needs to be signed by both parties. There must be an equal division of the property.

You want the rights to property etc. acquired during the marriage, so you do not want an annulment. See an attorney to ensure you get those rights. He may have a pension, retirement, etc. Even if his divorce was not final, you may have rights if you believed you were validly married.
