I need a quadro to transfer from my 401k to my wifes IRA in the divorce. I'm in Kent County Michigan. Who can do it and how much?

Cathy Lynn Naugle
Answered by attorney Cathy Lynn Naugle (Unclaimed Profile)

The easiest way to start is by callling the administrator of your 401k plan and asking.  Some 401(k) plans require only a copy of the court order (divorce judgment) that sets out what amount is supposed to be transferred. If a QDRO is required, the administrator may be able to send you a sample form and instructions, but it's very easy to make mistakes in completing them which can result in unintended financial loss to one party and unintended financial gain to the other.  Obviously, your safest bet would be to contact a family law attorney for assistance.

Your wife can try.. but it depends upon a lot of little facts.. are you intending to get divorced? see an attorney well before you actually intend to file

What am I entitled to in a divorce if only he worked?

Answered by attorney Dennis J Woods (Unclaimed Profile)
Divorce lawyer at Woods and O'Keefe
Yes! It happens all the time. Depending on the circumstances you are entitled to approximately 1/2 of the assets of the marriage. If there are children you may be entitled to child support. If the marriage is long enough you may be entitled to alimony. You are also entitled to 1/2 of the pension earned during marriage if there is one and 1/2 of any 401(k) or other assets.
