Is our house a common marriage asset?

Answered by attorney Thomas Weiss
Divorce lawyer at Vishnick McGovern Milizio LLP
Good morning, Since the house was purchased prior to the marriage it is not a marital asset.  However, that does not mean you do not have a marital claim.  You do have a claim for some of the appreciation at the very least.  You would not be entitled to one-half the house in a divorce but you do have some legal rights. Let me know if you would like a further consultation.

Divorce and Attorneys

Getting an attorney is a good idea - in addition to the home there are issues regarding pensions, IRAs and social security benefits that have to be considered as well as anything related to children, if you have them. The cost of a consultation is almost invariably less than the cost of making a mistake doing it yourself.

Yes, under the circumstances you descrine, you are in contempt. You will undoubtedly be sued and the consequences will likely include, but not be limited to, paying both sides' legal fees.
