You can make a motion to quash the subpoena and argue your reasons why the company should not comply with it, including your evidence about the timing as exhibits. Good luck!

Can I sue the woman my husband abandoned my family as she was previously his employer and now refuses to pay/hire him and help with child support.?

You cannot sue your husband's new girlfriend based upon the facts you provided.     However, if you have not done so already, you should file for child support in Family Court.  Even though he claims he is not employed, the court will still impute an income based upon his prior income, and if he is still able to physically find employment.   I provide a free consultation if you are interested in at the very least sitting down and speaking about your case and what legal options you have to ensure that the children are being supported.
