Is it true that I'll still be held accountable for this car loan even after divorce?

The agreement between two former spouses as to which debts each will pay as part of a community property settlement is applicable to them only. Third parties are not bound by that agreement. The parties to the note are still bound by its terms and are responsible to the bank for payment. The bank can require payment from any of the individuals that signed the note regardless of what the community settlement provides. However, as between you and your ex-husband, you may be able to hold your husband personally responsible for what you are required to pay to the bank along with any damages that are allowed under Louisiana law as a result of his failure to abide by the agreement This response is for general informational purposes only and is not intended to create an attorney-client relationship. For specific advise as to your situation, you should consult an attorney. Further, laws change from time to time and this response takes into account the laws of Louisiana as of the date of this email.

Husband has been gone 8 years and i can't find him to sign the divorce papers . can i still divorce him

Answered by attorney Ronda Elizabeth Harris
Divorce lawyer at Harris Law Firm, PLLC
Yes, you can file for a divorce by publication.      Divorce by publication happens only after a judge has been convinced, based on a sworn declaration, of the serving party's inability to find the Defendant after a "diligent search." Service by publication is commonly used in a divorce action to serve a spouse who has disappeared without a leaving a forwarding address. In Texas, divorce by publication is not an easy route to go. Divorce by publication has more steps, is more complicated, and is more expensive than an agreed divorce. In short, it is easier and cheaper if you can find your spouse and get them to sign off on the final divorce decree, but you can still get divorced.

Can I get re-married in Georgia after 30 days from filing for divorce in Alabama?

No. The waiting period for getting remarried runs from the day your Alabama divorce is FINAL, i.e. the day the judge signs the final divorce decree, not the day you file for divorce.
