It sounds to me like you already have an attorney and that you should be asking your attorney about this, not a stranger on the internet who has no chance to ask you even simple questions which must be asked in order to form an answer. A motion to dismiss is filed for various reasons. It is usually called a C4 motion and is usually accompanied with an affidavit by the Defendant stating certain facts.
It sounds to me like you already have an attorney and that you should be asking your attorney about this, not a stranger on the internet who has no chance to ask you even simple questions which must be asked in order to form an answer. Hopefully you had a private lawyer or public defender lawyer representing you, in what I assume was a plea negotiation? If so you should be asking your lawyer this question. However, if you have represented yourself, I suggest you consult with a criminal lawyer prior to your sentencing date.  Normally if you enter into a plea agreement then your only option is to accept the plea and comply with what ever prison sentence that you agreed to, or withdraw the plea. If you withdraw the plea, then you are subject to being sentenced by the judge after a trial and the jail time could be considerably more than was negotiated in a plea deal. With a year and a day, you will be in state prison, because county jail must be less than a year.  I suspect that is why the one day was added.  you may be eligible for good or gain time and may end up serving less than the full year.

You could possibly file a civil action against her for malicious prosecution. There has to be a determination in the criminal court that there was not probable cause.
