How much jail time can be expected for counts of possession with intent to distribute?

Each is a separate felony count. I suspect she is looking at about 3-5 years in prison. Therefore, I would recommend that she retain an attorney.

Can I be sued if someone I was with was arrested for theft and I was not?

I wouldn't worry about it at this point, although aiding and abetting and conspiracy come to mind, the fact that you left the store and was not arrested should put an end to it. If the police want to talk to you do not talk to the police, again, do not talk to the police.

Can my daughter be charged for illegal possession since she has a legal prescription?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
Criminal Law lawyer at Freeborn Law Offices P.S.
Absolutely she can. Assuming she has a legal prescription, it is for her own use, certainly not so she can sell it to other people. Once she starts selling the drug, she is in illegal possession of the drug and can be charged just as she has been in this case.
