Is being arrested and incarcerated without being given an initial hearing, grounds for a lawsuit?

Answered by attorney Clayton Lockhart (Unclaimed Profile)

It would really depend upon the facts and circumstances surrounding your arrest and incarceration. For instance, was this a mistake in identity? A screw up in someone's database? Any other kind of wrongful arrest? Were the cops committing some kind of egregious error? If the answer to any of these questions is yes, then you may have a valid civil lawsuit against the police and/or the city/county/state agency with which they are a part of. I have seen several lawsuits of wrongful arrest result in jury awards of several thousands of dollars, and one that I know of result in a jury verdict of over a million. Caution here though, if your arrest was valid then I wouldn't be expecting to prevail on any kind of civil lawsuit.

How is the process for first time theft misdemeanor?

default-avatar
Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
As a first time offender you should be able to get into a pre-trial diversion or intervention, or deferred prosecution agreement. The civil amount to wal mart can be negotiated with their attorney and you will receive a letter from them. There will first be an arraignment, and you should go to that, or if unable to go be sure to stay in contact with the judge's office. The public defender can be appointed for you, and you should stay in touch with them. Usually, the attorney makes a motion to continue and sends the original to the clerk and a copy to the State Attorney's office. The fees can be paid over the course of the deferred prosecution, perhaps as much as six months. Or the fines and court costs can be reduced to a civil judgment against you.
