The sentences are different, but even a misdemeanor assault is punishable by jail time. The max jail time on a misdemeanor domestic violence assault is one year. Whether you get any jail time is ultimately up to the judge.

Your attorney should be advising you on the risk/reward analysis of deal vs trial. If you don't have counsel, you are on your own.
