If a warrant is recalled, can police still arrest you on that warrant?

Answered by attorney Seth David Schraier
Criminal Law lawyer at Law Office of Seth D. Schraier, P.C.
If your judge recalled the warrant, the judge should have also provided you with a "do not arrest" order, that you should keep on you at all times. This is because there often is a delay between when a judge vacates a warrant, and the order is processed to inform the police. So until the police get notice from the court that the warrant is vacated, their system shows that their is still one out for your arrest. Therefore, if the police come looking for you, you need to show them the "do not arrest" order, so no further action is taken.

Should I write a statement admitting to unemployment fraud to the investigator?

default-avatar
Answered by attorney Eric E Rothstein (Unclaimed Profile)
Criminal Law lawyer at Rothstein Law PLLC
I think your instincts are correct. I have defended unemployment fraud cases and can't think why the investigators would not have you arrested. Both of my clients were very cooperative. I suggest you retain counsel.

Is it legal that I was placed on probation having never signed any forms or court documents of any kind?

default-avatar
Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
Criminal Law lawyer at Freeborn Law Offices P.S.
If you received a suspended sentence, then placing you on probation is automatic. The purpose of probation is to ensure that you comply with all of the terms and conditions that the court imposed upon you, including payment of fines and restitution. Yes, what the court did was legal. You need to comply or risk going to jail.
