You can try to assert anything you like. Whether it is a valid defense or works is a different question. It is illegal to carry a concealed weapon. You were caught with one after a complaint you had brandished one. You can see the credibility of the claim you face. Your version of the facts will be assessed as to credibility and validity in this case. When charged with any crime, the proper questions are, can any evidence obtained in a search or statement be used against you, can you be convicted, and what can you do? A little free advice: exercise the 5th Amendment right to SHUT UP and do NOT talk to police or anyone about the case except with and through an attorney. Raise all appropriate defenses with whatever witnesses, evidence and sympathies are available for legal and factual arguments, for evidence suppression, search and seizure, or other motions, or for trial. Effective plea-bargaining, using those defenses, could possibly reduce the potential time and other penalties you face. No amount of free 'tips and hints' from here or elsewhere are going to effectively help in a legal defense. If you think you can defend yourself pro per against these felonies without an attorney, you are probably making a much bigger mistake than carrying a conceal gun without the required permit. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate.

Hard to say. The DA has discretion to file or not to file and? they can push for jail, or prison, or straight probation without jail or prison. The fact that there is no loss means you have a chance at a lower punishment. Trying it twice may be a factor on the other side of the issue. You need a lawyer.
