How long can you stay in jail on a detention period?

default-avatar
Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
If charges are to be filed, you have to be arraigned on them within three court days. If you are arrested on Wednesday morning, that makes the following Monday the third court day. If Monday was a holiday, then Tuesday would be the third court day. If not timely arraigned within those limits, the charges have to be dismissed by the judge when they did bring you to court. That doesn't mean you'd walk out of court, since the DA would simply re-file and have the courtroom bailiff take you into custody on the new charges. If no charges were filed, then when you are brought to court, you would be released from custody there, if not earlier released from the jail.

How do I clear my warrant and ask for another court date without going to jail?

Answered by attorney Jared Christian Winter (Unclaimed Profile)
Criminal Law lawyer at Law Office of Jared C. Winter
For most warrants, you can have them cleared by simply going to a police station. In some counties, you can also go to the court. Unless the warrant has an extremely high bail, or no bail, then they will just cite/release you with a new court date. By the way, ideally you should have a lawyer advising you. If you can't afford to hire one, the contact the lawyer that represented you on your case.

Cynthia Russell Henley

You could be charged with DWI, intoxication assault, or if someone dies - intoxication manslaughter. They would have to prove that the xxanex caused intoxication and the intoxication caused the accident.
