You initially hired him. Then you changed you mind and fired him. He is entitled to be compensated for whatever services and expenses he incurred up until the point that he was fired. Your retainer did not have to be in writing.

I pleaded guilty and was convicted to class E felony (falsifying business records 1 degree). Was sentenced to 5 yrs probation with restitution.

Hi, Unfortunately, no. Once you plead guilty to a Misdemeanor or Felony in the State of New York, it is on your record. Probation is a sentence given simply to ensure you remain a lawful citizen. Finishing it does not negate a guilty plea. Unless that was the condition set forth in the agreement. Often times there are conditional pleas offered whereby you can be replead down to something after a certain period of time or completion of an action, such as probation or a program. However, based on what you're saying it doesn't sound like a conditional probation. Probation is a sentence, not a charge. What you were charged with and pleaded guilty to is there and will be there for life. Again, unless the probation was conditional.  It is extremely unfair that NY State offers no type of expungement, but nevertheless, that is the case. I'm sorry you're facing this but it seems to me like you may be stuck with a Felony record for the foreseeable future. Evan H. Nass, Esq.
