You have reported your husband missing, but the "someone" that may be using his debit card is your husband that does not want to return home to you. It is ok to use your husband's debit card if you have his permission. If you have questions about whether you have permission, then you do not have permission, which is strange since you are married.

Most of the time the prosecutor sets the court date, but when probation hearing is involved, defense attorneys can request that the judge's staff place the hearing on the calendar. Your brother's attorney may not know.
