What can my husband do against the false larceny accusations hurled against him?

default-avatar
Answered by attorney Marco Caviglia (Unclaimed Profile)
Criminal Law lawyer at Marco Caviglia, Esq.
The prosecution will have to prove your husband stole the gun. He has admitted he possessed it and claims it was stolen not by him but by the vendor. If there were 3 credible witnesses that witnessed the sale to your husband, that might end the matter. His attorney may use this information prior to an indictment to obtain deferral from prosecution or dismissal. Worst case scenario, he has a viable trial defense.

How can I help someone who is getting mistreated in prison?

Some prisons like San Quentin, have an ombundsperson who can usually be reached through the warden's office. However, a word of caution. First check with your cousin to see if he wants you to get involved. Your complaining may just bring even more heat down on him.

Go to traffic clerk. Give clerk name and date of birth or drivers license number. They can check county wide for cases. Keep checking every week.
