How long will it take for a court date to be set after a second DUI?

Answered by attorney Jonathan S. Willett
Criminal Law lawyer at Jonathan S. Willett Attorney at Law
Usually court has to be within 72 hours, unless he is on a parole hold in a separate county. In that case, he must figure out how to have himself transported to the right county. I can help with this situation. If you need more information, let me know.

What can be done if I am charged with the crime of H&S 11360(a) possessing marijuana to sell or transporting to sell?

Mark A. Broughton
Answered by attorney Mark A. Broughton (Unclaimed Profile)

Quite possibly, yes, several. You should consult with an attorney to go over your case in more detail, especially if you were arrested. Driving under the influence of marijuana by itself is a crime regardless of whether you have a prescription or not. Transportation for "sale" is also a crime regardless of the same. Marijuana is still a restricted controlled substance and illegal under federal law. You should find another place to store your medical marijuana; you are just asking for trouble.

If drugs were found in a vehicle that you were in, can you be found responsible or the owner of the vehicle in California?

It depends on the facts. Where were the drugs found? In your pocket,on a console where anyone could have had access or, on the floor in front of you? Was the owner present?
