Florida has some of the strictest mandatory minimum sentencing laws for drugs in the country. The mandatory minimum sentence for trafficking more than 28 grams (1 ounce) of oxycodone is 25 years. 28 grams equates to about 44 pills. According to the Florida Department of Corrections, more than 5,000 inmates are serving mandatory drug sentences. There is no constitutional right to a plea bargain. The decision as to whether to offer a plea bargain, and to what lesser charge, is up to the prosecutor. Lesser offenses In Florida include trafficking in 4 to 14 grams of oxycodone, which carries a 3 year minimum mandatory sentence, and trafficking 14 to 28 grams which carries a 15 year sentence. Perhaps your lawyer has relayed to you the prosecution's bottom line offer and been advised your boyfriend must "take it or leave it." If this is the case, your boyfriend's choices are to accept the offer or proceed to trial. There is no guarantee the prosecutor will make the same offer if your boyfriend turns it down and retains new counsel.  On the other hand, sometimes prosecutors decide to make a better offer on the eve of trial.  I recommend your boyfriend discuss further with his attorney why he or she believes further negotiations would be futile, and what his chances of success would be at trial. He should also ask his attorney if the offer is to a guaranteed 7 year sentence, or whether your attorney can ask the judge for less at sentencing. Your boyfriend  can then weigh the risk of proceeding to trial, which if he loses, will result in a 25 year sentence, and taking the plea deal with a likely 7 year sentence. Criminal defense attorneys can not guarantee a particular result when they are retained. Fees are based on factors such as the amount of time they spend on the case, the complexity of the case and their experience. If your boyfriend believes his attorney has not devoted sufficient time or effort on his case, I recommend he directly address this with the attorney before making a decision to change counsel.
