Could a company press charges after terminating an employee for receving money from a resident?

Answered by attorney Diana L. Anderson

The Assisted Living facility must have a policy that prohibits employees from taking any thing, even gifts, from residents.  They do that to protect people who may loose capacity.  It is going to take more that the resident that gave you the money "saying" she is not going to press charges.  you will need ot get a written statement from her, and possibly some meidcal evidence that she is still lucid.  I don't beleive the facility can press charges on her behalf without her cooperation.

It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your case. He/she would then be in a better position to analyze your case and advise you of your options.
