Is a search on private property legal?

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. It depends on the circumstances. Your question does not state whether you were arrested, charged, or cited for anything. I strongly that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.

Was there any probable cause for me to be searched?

Answered by attorney Craig Orent
Criminal Law lawyer at Orent Law Offices, PLC
Based on the call to the police and the circumstances related to them, the officers had the right to approach you and temporarily detain you to learn more. They typically have the right to do a quick pat down search for weapons but no more (unless feel some other object during the brief period that they are investigating which is related to the purpose of the investigation, like a baggy of drugs during a drug investigation). If you claim you don't have any identification or otherwise refuse to provide, then the question as to if the police can search you for the ID is less clear. Few courts have addressed the issue. Although one court (not in AZ) has held the search to be proper, commentators have called that conclusion into question, and other courts have rejected it. For example, Jones v. Commonwealth, 279 Va. 665, 691 S.E.2d 801 (2010) (where defendant, stopped for traffic violation and suspicion of drug transaction, claimed not to have any identification with him but frisk established he carrying a wallet, that not basis for searching wallet). But the issue is still up for debate nationally. Regardless, there was no reason, if you were not arrested, for the officer to keep your wallet.

Am I required to move the court date if I get military orders to leave the area?

Leonard D. Harden
Answered by attorney Leonard D. Harden (Unclaimed Profile)
Criminal Law lawyer at Harden Law Office
Assuming you are the defendant you should continue the trial date. If you don't a default will be issued and contempt charges can be filed. If you are active military you may be in trouble if you have active criminal charges against you.
