Can you present evidence during an opening statement?

Criminal Law lawyer at Freeborn Law Offices P.S.
Generally not. The proper foundation has to be laid for the admissibility of any evidence. This generally happens during the actual case when the respective parties present their cases and their supporting evidence.

What to expect when being charged with 3rd degree shoplifting for the first time? Store received property back and items never left store property.

You can probably get the charge reduced to a municipal ordinance, but will be ordered that you cannot retirn to the store from which you shoplifted.  If you seek representation, I may be reached at (908) 770-7326.

Can I be made to provide evidence to who committed the crime if I was there but did not commit the crime myself?

Gregory Casale
Answered by attorney Gregory Casale (Unclaimed Profile)
Criminal Law lawyer at Gregory Casale, Attorney at Law
I would need more information to answer this question. You certainly have the right not to incriminate yourself. However, withholding evidence that will not harm you can be an obstruction of justice charge. You should have a lawyer who can advise you specifically on this. It is an important issue.
