What should I do if I am charged with possession of cannabis with intent to deliver?

Answered by attorney Amanda Bowden Johnson
Criminal Law lawyer at The Houser Law Firm, P.C.
Dude, this is gonna be harsh but you need it! You don't understand squat! If you did - you'd have never had that much cash, gange and paraphernalia up in a college campus apartment - man, talk about amateur hour - you were just begging to be made an example of! If being stupid was a crime you'd have also been charged with multiple counts of felony being a ding dong. If you think a felony conviction is only on your record for 7 years, you have been sorely misinformed - that bad boy will be there for life and your future job opportunities just dropped to junior shrimp scrapper at your local Billy Bob's Crab Shack - if you're lucky! Further, you are ironically right that constructive possession doesn't apply to you but it ain't because you understand squat all about it, its because you were in actual possession, hence the charge for possession. Quit thinking you know what you are doing and go hire an attorney who actual does know before you make things worse. Hopefully, this has learned you not to mess around with drugs because frankly, you ain't good at it but if not, in the future at least don't be so dense as to do it in a manner equivalent to hanging up a giant sign that says 'Amateur drug dealer here - please feel free to bust me!'

If your case was dimissed before charges were filed do you have a right to your police records?

default-avatar
Answered by attorney Steven Jed Alpers (Unclaimed Profile)
Criminal Law lawyer at Steven J. Alpers, A Professional Corporation
If you are factually innocent you can petition the court for a finding of factual innocence. That would result in a sealing of your record.

What is the charge for crack cocaine?

default-avatar
Answered by attorney Jon Martinez (Unclaimed Profile)
Criminal Law lawyer at The Jon M. Martinez Criminal Law Group
Crack cocaine is considered a narcotic drug and possession of a narcotic drug is classified as a class 4 felony offense in Arizona. If you have no prior convictions, a class 4 felony usually has a presumptive of 2.5 years in prison and a maximum of 3.75 years in prison. You are also eligible for probation for a maximum of 4 years with fines and community service generally being required. However, in a case of simple possession of narcotic drugs with no criminal history, you will likely fall within the guidelines of prop 200 which would allow you to avoid jail or prison time if certain requirements are met. It may even be possible for you to enter into a diversion program that would keep a felony conviction off of your record so long as certain requirements are met, which include successfully completing drug testing and drug treatment.
