Will I do jail time for possession with intent?

default-avatar
Answered by attorney Lawrence Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
It doesn't matter how much marijuana you had, it matters how it was packaged. If you were initially given a $ 200,000 bond, then you should expect jail time. 12-18 months in custody followed by probation.

Is it legal for an attorney to offer a plea bargain to the accused without them seeing the motion of discovery?

default-avatar
Answered by attorney Kristi Noelle Gladden (Unclaimed Profile)
Criminal Law lawyer at Gladden-Flenniken & Associates, LLC
It isn't illegal for an attorney to tell the Defendant about a plea offer made to him by the prosecutor in fact it is the attorney's obligation to tell the Defendant about any offer given as soon as possible. However, telling the Defendant about an offer is different than encouraging a Defendant to take an offer without seeing the Discovery. The actual motion filed by the defense attorney isn't what's important it's the evidence given to him by the prosecutor that a defense attorney has the obligation to show to the Defendant. The Defendant always has the right to view the evidence and discuss any possible defenses to the charges with his attorney before making a decision to accept or decline an offer. It isn't illegal, per se, but it could be viewed as unethical to pressure a Defendant to accept a plea offer without reviewing the evidence with him if requested.

How long can he keep me pulled over while he is checking my paperwork and warrants and my papers were up to date and legal and were my rights violated

Answered by attorney Lawrence Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
You don't have any rights after that point. What do you want to hear? That after 20 minutes, you can demand your license, and/or pull off if you want. You will remain there until the police officer completes what he needs to complete. After all you are the guy that vacuums at 4:00 a.m. So you know the importance of paying attention to detail.
