Can my probation officer search my room or house when I’m not home?

Answered by attorney Ernest Lee
Criminal Law lawyer at Lee Law Group DUI Criminal Attorneys
Yes, you are subject to a waiver of your fourth amendment rights, i.e., your right to not be subject to unreasonable searches and seizures conducted by the state, (the Cops) , when you are on probation or parole because you probably both agreed to such waivers and it was a condition of your probation or parole. Therefore, you had no choice. The basis for this waiver being a condition of P & P is that if you were in jail, the alternative of probation or parole, you would have even less privacy, and could be searched anytime. Thus, the state, here in the form of a State Probation Officer, can search your papers and person arbitrarily without your consent.
