How does one get a restraining order lifted?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
It is not a restraining order; it is a protective order. You can call and make an appointment to talk with the prosecutor first about your wishes. If that does not work, you can call and try to make an appointment with the judge. If you cannot get an appointment, show up on your husband's court date. The judge will want to be assured that not only are you protected, but your children are protected, too. Be aware that everything that you say to the prosecutor and / or the judge can be used against your husband when they call you as a witness if the case goes to trial.

Get an attorney and face the music. You have to get this corrected or your alleged violation will be deemed to be continuing.
