Will I get an underage and if so, what will likely be my punishment?

Answered by attorney Nathaniel D Shafer
Criminal Law lawyer at Natty Shafer Law
Yes, it's possible you could receive a court date in the mail. You should not talk to the police any more about your case and hire a lawyer if they do decide to prosecute you.

What do I have to show to get out of charges for driving with knowledge of a suspended license?

default-avatar
Answered by attorney Mark August Nitikman (Unclaimed Profile)
Criminal Law lawyer at Croudace & Dietrich LLP
Cases are treated differently depending on the jurisdiction, the Judge, and the prosecutor assigned to the case.  You should bring all of the paperwork you have regarding the change in insurance companies to court with you, along with anything else which would support the fact that you were unaware of your license suspension.  Most importantly, you should obtain (if you haven't already) and bring to court with you a valid license.  In many jurisdictions, if you have no prior record and can demonstrate that you have since obtained a valid license, the charges will be dismissed by the State. Ultimately, if the case were to go to trial, the State of Florida would have the burden of proving that you had knowledge of the suspension.  Be prepared to demonstrate to the State that you did not have knowledge, and that you have since rectified the situation.  As always, it is best to retain counsel prior to your scheduled court appearance.  A local attorney who handles such cases can best advise you what to expect, and how best to defend the case.

What will my boyfriend facing after he had caught shoplifting for the second time? And what can be done to help with his sentencing?

default-avatar
Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
He is facing the substantive charge as well as a violation of probation. I believe that he will be convicted this time and might even get two convictions, which means that the next time he commits a petit theft it could be a felony for which he could go to prison. I might be wrong, it could be the 4th time, with 3 prior convictions. He should be able to get a bond.
