The purpose of bail is to secure a defendant's appearance at court when required. There are several methods of posting bail in a criminal case. The most common forms are cash, surety, real property and personal recognizance. Typically, a surety bond is posted by a bonds person, who charges a percentage of the bond amount as a fee or premium. When the case has concluded, either by dismissal of the charges or after sentencing, if the defendant has appeared as required, the bond is ordered discharged. If the full amount of the bond was posted with the court in cash, the court will return the money to the person who posted it. However, if a bonds person was used, you will not receive any money back, as the premium you paid was merely a fee for his or her services. Some courts allow arrestees to be released upon posting a percentage of the total amount of bond with the court. In essence, they serve the function of the bonds person. In New Jersey, where you are from, judges are authorized to allow release upon posting a percentage of the bond amount, except for specified serious crimes. In such cases, the bond money is returned to the person who paid it when the case is over and the bond has been discharged.
