Is there a way that I can avoid losing my license after getting an MIP infraction in California?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
You can fight it. If you arent convicted, you dont lose your license. When arrested and charged with any crime, the proper questions are, can you be convicted, and what can you do? Defend the charges. Go to court, enter a not guilty plea, set up and attend the court trial. Raise all the available defenses with whatever admissible and credible witnesses, evidence and facts are available for plea-bargaining or trial. If you don't know how to do these things, then hire an attorney that does, who will try to get a dismissal, reduction or other decent outcome through plea bargain, or take it to trial. If serious about doing so, and if this is in SoCal courts, feel free to contact me. Ill be happy to help you. If you can't afford private counsel, you can apply for the Public Defender.

Can I go to jail for my action on defending myself out of fear of being hurt by the man I was arguing with?

Yes, it's possible. But it sounds like you have a good defense. Contact some attorneys to discuss your case.

What should I do if charged with having sex with a minor?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)

What should I do? Well, either plead guilty and go to prison with registered sex offender status, OR defend the charges. what can help my case? Hiring an experienced criminal defense attorney. When charged with any crime, the proper questions are, can any evidence obtained be used against you, can you be convicted, and what can you do? While this isn't a 'capital case', it certainly carries potential jail or prison time, so handle it right. Raise all appropriate defenses with whatever witnesses, evidence and sympathies are available for legal and factual arguments, for evidence suppression, search and seizure, or other motions, or for trial. No amount of free 'tips and hints' from here or elsewhere are going to effectively help in a legal defense. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate.
