The statute of limitations is 10 years or until the victim is 21, whichever occurs later. Once filed, the prosecutor will issue a warrant for the arrest and probably a warrant to collect DNA. They will have to find him in order to arrest him or get the DNA unless he turns himself in. Once the charges are officially field, that stops the statute of limitations clock from running. You can try hiring a private investigator to find him if you are having trouble locating him.

Fraud is done on purpose. So if you made an honest mistake you most likely aren't looking at a fraud situation but you could still be in trouble because generally ignorance of the law is not an excuse. If people are not attorneys - they are not expected to know the law. That would be why there are attorneys for people to consult with about the law.

If you are served with a subpoena, that is a court order and you must appear on the date and time requested. However, if you are unable to attend, the best advise is to contact the attorney who sent the subpoena and make arrangement to be available by telephone. This would allow you to stay at your job and only appear in court when you are needed. Most attorneys will work with you and accommodate your schedule.
