Can assault charges get dismissed if the victim left the country?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
You need to hire your friend a good trial attorney. The DA can still make this case with the officers report. It tougher to make the case without her, but not impossible. Need to hire him and attorney and fight this thing.

Is there a statue of limitations on a Class A Misdemeanor?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
There is a two year statute of limitations for filing a complaint in a misdemeanor. The practice in Dallas is to carry the case after filing for a number of years. Each County has a different practice. The state has a duty to make reasonable efforts to locate and arrest and it may be a defense that they took too long. If you have been at the same address and it is a published address you may be able to use this defense if you are arrested.

Looking for a lawyer out of Harris County/Houston to represent my son

Answered by attorney Tristan Nicolas Legrande
Criminal Law lawyer at LeGrande Law
Yes. Thay should be sufficient for pre-trial representation attorney expenses. If the case required representation during a jury trial, costs could be higher. There are a multitude of variables that would impace this. Many attorneys charge one fee for pre-trial representation, and the trial costs are only incurred if the case is set for trial. Your best bet at finding the right attorney is to read attorney reviews, then contact several directly to inquire about a consultation. Choose the one you - and most importantly, your son - trust will defend your son the best.
