Can i be charged with theft because of something left in a car

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
You have a good case for a trial. From what you wrote there is a good defense and your attorney should be able to either get the case dismissed or set it for trial.

I think you have a good case and you can certainly try to represent yourself. However I believe that your chances of success will be greatly enhanced by hiring an attorney that work in this area of law, and one that you feel comfortable with.

If you are suspected of shoplifting and are not on the property anymore can the owners follow you search you and have you arrested

Search and seizure laws do not apply to private individuals, like store employees.  They are there to protect citizens from the government, not from each other.  Without more information I would say the owner's action would not prevent a prosecution of you or use of the evidence of the stolen property found on you.
