If you successfully completed diversion, there is nothing to expunge. An expungement dismisses a case after you've finished serving all your penalties. Diversion does exactly the same thing. If you completed diversion and the case was dismissed, you can honestly tell a prospective employer that you've never been convicted of a crime.

After 16 years, it's probably too late to do anything. The appeal period is long gone. You could contact an criminal defense attorney experienced in post-conviction relief for a face-to-face consultation and give him/her all of the facts surrounding your case. (S)he would then be in a better position to analyze your case and advise you of your options.

You may have a case worth defending. You don't have to testify I'd recommend against it since you admit smoking the marijuana and make the prosecutor prove you actually smoked it. The prosecutor will need the officer to testify he say you smoke, and the officer might not be willing to say that because he might not remember you or he might be completely honest.
