Can I get a felony 1 charge expunged.

Answered by attorney Tristan Nicolas Legrande
Criminal Law lawyer at LeGrande Law
No, you cannot get offenses expunged unless they were dismissed without any type of probation or community supervision, or you were found not guilty at trial.   However, 5 years after you complete deferred adjudication - you can get an order of non-disclosure entered by the court. That would basically seal the record relating to the offense from public disclosure (although law enforcement and government agencies would still be able to see it).   Good luck.

You would face no penalties if the jury at your trial believes you did not know the drugs were there. You are not guilty of possessing something of which you are unaware.
