If I went to prison for 3 years and the judge worked with my wife as a courtroom employee, can I get a mistrial for this?

The case is over. However, it is fascinating. Someone/judge that worked with your wife for 15 years did not believe your wife when she stated that you did not strike her. What does that say about your character? Your employment prospects will remain the same, which is really what this question is about.

What can I do if I was accused and arrested of stealing a vehicle?

If you have not been prosecuted, then you will need to hire a lawyer to expunged your record. If charges were never actually filed then there is nothing you can do except perhaps file a complaint against the officer.

Can a case that was dismissed with prejudice be used against me to violate probation in another county?

Mark A. Broughton
Answered by attorney Mark A. Broughton (Unclaimed Profile)

Yes. It is not the conviction of a new offense that is required for a VOP, it is conduct. So, let's say you you have standard drug and alcohol restrictions as a condition of probation; if you give a dirty test, or are caught with alcohol on your breath by your probation officer, that can generate a violation petition. Again, it is the conduct not the conviction that can be used to violate probation.
