First and foremost, ASAP hire a lawyer who has experience handling Criminal Sexual Conduct charges to defend you - these charges are VERY serious. I would never recommend my client agree to submit to a police-administered polygraph test unless they had FIRST passed a confidential, independent polygraph test by my own polygraph expert.

I am trying to find out the legal explanation of "Grand Theft Auto" in Colorado. I have heard two different things, that it is when you steal a car and take it across state lines and that it is charged when the stolen vehicle is more than a certain dollar amount. Colorado does not have an offense called "Grand Theft Auto" but it does have an offense called "aggravated motor vehicle theft." The statute number is C.R.S. 18-4-409. Aggravated motor vehicle theft can occur a number of ways. In all cases, you would have to knowingly obtain or exercises control over a vehicle belonging to someone else without their permission or by threat or deceit. If the state could also prove any of the following, then the statute would apply: You kept control or possession for more than 24 hours. You tried to or did alter or disguise the vehicle. You tried to or did alter or remove the vehicle identification number You used the vehicle to commit a crime other than a traffic offense During the time you had possession or control of the vehicle, you caused more than $500 in property damage. You caused bodily injury to someone while in possession or control of the vehicle You removed the vehicle from Colorado for more than 12 hours. You attached license plates to the vehicle that belonged to another car. Violations of any of the above provisions are a class three felony if the vehicle is worth more than $20,000. and a class four felony if it's worth less. It's also a class 3 felony if you have two prior convictions for auto theft in any state. You also lose your driver's license. If you didn't commit any of the factors above and merely knowingly exercised control or possession of someone else's vehicle without consent, then it's a Class 5 felony if the value of the motor vehicle is $20,000 dollars or more; a Class 6 felony if the value is at least $1,000 but not more than $20,000. If the vehicle is worth less than $1,000 and none of the factors apply, the offense is a misdemeanor. The laws and penalties will vary from state to state. The above applies to Colorado, the state you inquired about. Class 3 and 4 felonies can result in substantial prison time. Short answer to your question is that the officer's identification of you will certainly be sufficient to provide evidence the offense was committed by you.  The officer no doubt got your name and date of birth, probably your drivers license or other ID. Many officers wear body cameras now so the interaction with you may have been on video.  Based on what you have said, to me it is not a good strategy to rely on 'they cannot prove it was me' as a defense.
