I have won this case before a jury. It sounds like you were supposed to make a deposit and did not. You did not because you lost the deposit. that is not theft, nor any crime, it is just a bad mistake. you can be charged, but it should be difficult to prove if the police come to talk with you, you do not have to talk with them - you should just say I want an attorney there is nothing you can tell them today that you cannot tell them tomorrow after speaking with me - besides, you already told the boss that you lost the deposit - you cannot tell the police any more.

Without seeing the police report, it is impossible to definitely know why you were arrested.  However, based on legal knowledge and experience, an attorney can make a good educated guess. It is possible that you were arrested because the law enforcement officer who had you perform field sobriety exercises (often referred to as "tests") concluded you were under the influence of alcohol or some other intoxicant to the degree that your normal faculties were impaired.  In Florida, you can be convicted of DUI in two different ways:  (1) by having a BA (blood alcohol) reading above the legal limit; or (2) by your normal faculties (or ability to perform certain tasks - such as touching your nose or maintaining your balance) being impaired.  Number (2) can result in your arrest regardless of any BA reading.
