Can you own a firearm on a wobbler felony after completing all probationary requirements, case was set aside and dismissed?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
I am not sure what you mean by a wobbler felony. Was this a case that was dismissed as part of a deferred sentencing agreement? If you have been convicted of a felony you cannot use, own, or possess a firearm until your rights have been restored. How that process works and how long you have to wait depends on what type of felony you were convicted of.

What can I do if I am being slandered for over year?

Thomas C. Bulman
Answered by attorney Thomas C. Bulman (Unclaimed Profile)
Criminal Law lawyer at Bulman Law Associates PLLC
If none of that is true, get the names and numbers of 3-5 people who can verify the false statements made and go to a lawyer. Slander is very difficult to win and actually receive money payments unless this defendant works for your old company and they can be drawn into the lawsuit. The more outrageous the lies, the better as long as you can get good witnesses who have no bias or reason to lie about the defendant's statements. Some might think it is a funny prank but it has gone too far.

What will happen if I received a letter that I have been charged with theft misdemeanor under $500?

Answered by attorney Laurie A. Schmidt
Criminal Law lawyer at 5280 Law Group
The letter you received sounds like a Summons. This means you must appear at the courthouse, on the date, and time indicated. Failure to do so, could result in a warrant for your arrest. You have a right to have any attorney present with you. As for the charge, if the value taken is alleged to be between 500 and 1000, it's misdemeanor allegation. You should consult a lawyer about the case and any potential defense that you may have.
