You asked several questions. Is what you have described a burglary? It depends on the facts. You do not have to steal anything to be charged with burglary. They must have evidence that you entered a building with the intent to commit larceny, or any felony, inside. You other question is whether you can get your case dropped if you pay restitution. No one on here can answer that question. What you need to do is hire a local criminal defense lawyer to review and negotiate the case. If you can't afford to hire one, go to your court date and ask the judge to appoint the public defender.

It is probably not possession, but it could still be theft if his record is clean, its unlikely he would get a jail sentence, but he may end up with a criminal charge - likely misdemeanor.

There may be certain options that could keep your public record clean such as a diversion program which is often offered for first time offenders. at charged, you do not want to go in there alone.
