Generally, a 12 year old conviction cannot be overturned. Contact a lawyer in your state, California does not have classifications of charges so you must live somewhere else.

Can an expunged felon own a gun?

default-avatar
Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
Interesting question because we do not expunge the felon. The records are expunged, not the person. To expunge the person would probably mean that the person will no longer be alive. So, your question is whether dead people can own guns. A felon who has had his or her right to own firearms restored can own a gun. In order to have the records expunged, there cannot be a conviction. So, the person would not be a felon and could probably own a gun. Before you go an get a gun, make sure that you are not a convicted felon. It could mean up to 15 years in prison if you are.
