Can the police keep an accused in jail if the records pertaining to his crime are destroyed?

Answered by attorney John F Brennan (Unclaimed Profile)
Criminal Law lawyer at Musilli Brennan Associates, PLLC
I would suggest to see an attorney immediately, obviously if there is no remaining evidence of the crime then it would be possible to seek to have the charges dismissed. On the other hand, it is not the record of the crime and the police files but rather the witnesses which supports prosecution and conviction.

Yes, there is nothing improper about that. Each prosecutor is different. Some may contact you after you send it and some won't.

You should tell the truth and take the punishment, or retain an attorney and create a believable lie.
