The civil statute of limitations for fraud is 3 years. The criminal statute of limitations for fraud by deception is 6 years. Not sure a prosecutor will file criminal charges on this one. You may have to file a civil action. If you choose small claims court you have to sue where the defendant resides; that would be Colorado. You may be able to sue him in a higher level court in Arizona since he was "doing business in the state". You may be lucky enough to get a judgment, but then you have to find a way to collect. That could be difficult.

Measure 11 crimes as I understand them are in Oregon and deal with habitual offenders and enhanced minimum sentences. I am a Michigan Attorney and not familiar with the ramifications. I would suggest contacting an experienced criminal attorney in Oregon.
