Can I get my record expunged on a recent case? How?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
You can only expunge cases for which you were found not guilty or they were dismissed without you getting probation, a fine, or jail time. If you received a deferred adjudication probation on them and completed it successfully, you can petition the court for nondisclosure (sealing). You would need a lawyer to help you.

What happens for a first time probation violation?

default-avatar
Answered by attorney Robert Conover English (Unclaimed Profile)
Criminal Law lawyer at The English Law Firm
The court has broad discretion in a probation violation. They can reinstate probation with no penalty or they can impose up to the maximum remaining jail time. It depends on the facts of the violation and the judge that hears it. You can make a motion to withdraw a plea, but there is no guarantee that you will be allowed to withdraw it. The court will make a finding as to whether your plea was knowing and voluntary with an understanding of the nature and consequences of your plea.

What are the chances that the judge will drop the HS 11550(a) charge against me?

Criminal Law lawyer at Francis John Cowhig
If charges have been filed, the judge will not dismiss the charges. I suggest that you retain an attorney as soon as possible to represent you in this case.
