Has he been convicted or is the prosecution still on going forward. If the case is still open, I strongly suggest you retain a private defense attorney ASAP. He clearly needs to defend against the charges, otherwise he is looking at a state prison sentence of 15yrs. to life.

Theft is theft. It is good that he returned the items but if he admitted to the cops that he intended to steal them, he's guilty of theft. Which means he has violated probation. Which means he can and probably will do some jail time.

You can't request anything, but your husband's attorney can make the request, although if he has already been sentenced, it may be too late. You need to speak with your husband's attorney.
