If I was charged with a crime but wasn't indicted and it did not go to trial, will employers see this on my record?

Answered by attorney Seth David Schraier
Criminal Law lawyer at Law Office of Seth D. Schraier, P.C.
Private employers can only see your record which is not considered "sealed." A criminal conviction (misdemeanor or felony) will show up on a background check, but an arrest will usually not appear. The only instances where it has shown up in my experience, is where you need to consent to an FBI background check, which will still show any arrest you have ever had. There is no way to erase that, as it is only accessible to criminal justice agencies.

If you have been released on a Desk Appearance Ticket you have already been arrested and charged with a criminal offense. Hire a Criminal Defense attorney to represent you.

Will I need a lawyer if I was arrested for carrying brassknucles through airport security?

Answered by attorney George A. Vomvolakis
Criminal Law lawyer at Law Offices of George Vomvolakis
Possession of brass knuckles is a "per se" crime.  What this means is that it is a crime simply to possess them regardless of what your intentions were. This charge is an 'A' misdemeanor.  Get a good attorney to make sure you don't end up with a criminal record.
