In Florida it could be prosecuted as grand theft, a third degree felony for which the maximum would be 5 years in prison. You have the option of calling the cops and reporting the crime. He did not know it was for him at the time he took it from you. Yes, it is a crime.

This is the time to make sure that you subpoena the records of the phone company to show that you attempted to make the calls you attempted to make.
