He should report the crime to the police. No one knows what is likely to happen to her, until we hear what her defense will be. If her defense is he told me to make the payments by whatever means necessary, and the prosecutor beilieves that, then she will likely get probation. if she can repay the money, then she will get probation. Who cares what she will get? He needs to report the crime, IF there is a crime.

It is probably not vandalism, but it is probably theft. You hired a cheat to landscape for you. If he is prosecuted criminally, then you can request restitution, to be paid over the next three years. If you sue him in civil court, the judge will construct a similar payment plan. He cheated you, and has spent that money.
