Can you buy a gun in Georgia if you were charged with a simple battery misdemeanor?

Answered by attorney Lawrence Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
I don't know. I suspect that if the fourteen year old simple battery conviction does not involve a domestic matter, you should be able to purchase and possess a firearm, BUT THE QUESTION REQUIRES RESEARCH. Therefore, if it is important to own a firearm, you will probably have to break down and pay an attorney to do the research: (1) pull your conviction; (2) research the law from 14 years ago; and (3) research the question from a 2011 perspective.

Can my mother-in-law be released from prison to her convicted felon boyfriend?

She is not being released to anyone, because she is grown. She is being released and allowed to reside with certain persons. Who she is allowed to reside with is a decision of parole.

What will happen in court for a first offense in criminal mischief?

default-avatar
Answered by attorney James E Gandy (Unclaimed Profile)
Criminal Law lawyer at Law Office of James Gandy
Though there may be some usual outcomes for a criminal mischief case (and, to be clear, people do not usually receive jail for a first time, minor offense), this question is impossible to answer given the format provided. First, there is no clear understanding of the facts and circumstances surrounding your case - amount of damage, type and quality of evidence against you, your age, additional information about what happened, etc.; even if you provided much more information, there could be still other information that you did not provide that could change aspects of the outcome. Second, it is unclear where this offense occurred and different courts treat cases differently; when I worked in Brooklyn, the typical first time drug sale resulted in little or no jail; in up state New York, however, defendants would do years for the same offense under the same circumstances. Thus, no one will be able to appropriately answer your question. You will need to consult an attorney in your area.
