Is it legal to hold a prisioner in SHU for 8 months?

Elmer Robert Keach
Answered by attorney Elmer Robert Keach (Unclaimed Profile)
Criminal Law lawyer at Law Offices of Elmer Robert Keach, III, PC
Yes, provided they gave him appropriate notice, and an appropriate hearing to contest disciplinary charges.  It is routine for inmates to be put in the SHU for misbehavior.  Some inmates are placed in the SHU permanently if they do something really bad, like assaulting staff.     Hope this helps.   Bob Keach

Is law enforcement legally obligated to notify the parent/guardian of a minor child that has been taken into custody?

Answered by attorney Maryam Jahedi (Unclaimed Profile)
Criminal Law lawyer at Maryam Jahedi Law Firm
Yes they are. Under the Family Court Act they are obligated to notify the parent/legal guardian. They are not supposed to question the minor before notifying the parent and without the parent or legal guardian present when the minor is given Miranda warnings. Statements made by the minor to the law enforcement may be suppressed for failure of the law enforcement to comply with this requirement.

Radar guns must be checked how often by law?

Richard Francis Sweeney
Answered by attorney Richard Francis Sweeney (Unclaimed Profile)
Criminal Law lawyer at Richard F. Sweeney, Attorney at Law
The officer should have tested the radar gun when he started his shift. he should have tested it in 2 ways. One of those ways can be an internal test which the radar gun has. The other test could be anything from observation of the officer when pointing the gun at a moving vehicle and checking the speed.
